Strategic Coach^® CoachCon 2024 Terms & Conditions

The Strategic Coach Inc., The Strategic Coach USA, Inc., and The Strategic Coach UK Ltd. (“Strategic Coach”, “we”, us”) are pleased to provide you with access to Strategic Coach CoachCon 2024 (“Event”). The Event is interactive and designed to provide our Strategic Coach community (“Participant”) with the opportunity to connect with other entrepreneurs, learn from subject matter experts, and help strengthen your knowledge of Strategic Coach^® concepts and tools and achieve extraordinary goals. In order to assist us in maintaining the unique value you will experience as an attendee at the Event, you acknowledge that you have read, understood, and agreed to the following Terms and Conditions (“Terms”) as a condition of your registration for the Event.

Conditions Of Your Application

Your Investment Fee (“Fee”) permits you to access to the Event and its content. The payment of the applicable Investment Fee is due upon registration. If any payment includes “early bird” rates or discounts, booking and payment must be received before the deadline date listed. Fees may be subject to taxes, which, if applicable, may be charged to you in addition to the fees. Subject to our limited cancellation, transfer, and refund policy, all registrations are final and are otherwise non-refundable. Fees are exclusive of any travel or other related costs and expenses you may incur in attending the Event. It is each attendee’s sole responsibility to take care of visa and travel requirements. If you require an entry visa, you must allow sufficient time for the visa application process. The Event is intended solely for your own personal, professional, educational, and non-commercial use. By signing up for or subscribing to any of the Strategic Coach^® Services, or by attending any Strategic Coach^® sponsored events, or filling out any Strategic Coach^® download forms, you and your team are providing express consent to be contacted by us via commercial electronic messages, mail, text, SMS, MMS, telephone, or otherwise to notify you about new products, services, and features offered by Strategic Coach^® (messages and data rates may apply). You may withdraw your consent at any time. We may also post updates about the Event by posting notices on the Strategic Coach^® CoachCon 2024 registration website. You are encouraged to visit the website from time to time in order to review any updates that we may provide.

In addition, by registering for the Event and by downloading the Strategic Coach^® CoachCon 2024 mobile app, you consent to our listing you as an Event attendee through our Event digital platforms. Accordingly, other attendees may contact you electronically. If you do not want to be listed as an Event attendee or contacted by other attendees, please do not download the mobile app. You will also be added to our Attendee List for notifications of future events. If you would like to opt out of any of these benefits, a link is provided in each email to provide the ability to opt out or you can send an email to legalinfo@strategiccoach.com.

Photos/Videos/Recordings. We understand that you may see friends and colleagues, and we absolutely encourage you to take pictures outside of the Event areas and to share those pictures as you desire. Recording of the Event, whether in whole or in part, in any format is not permitted. Information that we are sharing within our Event (e.g., keynote or breakout sessions) is Strategic Coach^® intellectual property and, therefore, you may not share any photos or videos you take of any Event session publicly via social media or otherwise without our express written permission. Notwithstanding the foregoing, video, photos, or other recordings of certain sessions or areas within the Conference may be further restricted or prohibited.

Cancellation; Transfers; Refunds. Strategic Coach^® will not be responsible for any losses or other damages whatsoever, including but not limited to airline cancellation fees, to the extent the Event or your registration is canceled by us in accordance with these terms and conditions or by you, by the hotel venue, or as a result of any other event outside of our control. Refunds will be granted as follows: If you cancel less than 30 days before the Event, no refund will be provided but your Investment Fee is transferable to future Strategic Coach^® Program Fees. If you cancel more than 30 days before the Event, 50% of your Investment Fee will be refunded to you, and the remaining 50% of the Investment Fee will be transferred to future Strategic Coach^® Program Fees. Investment Fees may not be transferred, traded, or sold to others without the express written permission of Strategic Coach^®.

Information Subject To Change; Speakers. The information we provide about the Event is for informational purposes only and is subject to change. This means we may change certain aspects of the Event, including the name, content, program, speakers, venue (including from a physical in-person event to virtual and vice versa), date, and time. Every effort will be made to provide a program of equivalent standard and value should unavoidable changes occur. Views expressed by speakers are their own.

No Solicitation. In order to ensure a spirit of collegiality at the Event, please respect our policy which provides that no attendee may engage in any type of self-promotion or conflicting activities at or in connection with the Event. Accordingly, you may not distribute, display, or place, or cause to be distributed, displayed, or placed, advertising or other marketing materials (including any fliers, handbills, books, articles, or anything of value) or otherwise solicit business of other attendees in any way in, at, or about the Event without our prior written approval, which may be withheld at our sole discretion. In the event of a violation of this Section, in addition to the other rights and remedies available to us, Strategic Coach^® may refuse admission or eject you from any session if you violate these Terms and Conditions or our related policies.

Intellectual Property

You acknowledge and agree that the Event includes content protected by copyright, patent, trademark, trade secret, and/or other intellectual property and proprietary rights and laws. No right, title, or interest in any intellectual property or other proprietary right shall be transferred to you by your participation. Any reproduction, presentation, distribution, transmission, or commercial use of the concepts, strategies, methods, materials, and all other trademarks, copyrights, and other intellectual property owned by The Strategic Coach Inc./The Strategic Coach USA, Inc./The Strategic Coach UK Ltd. (“Strategic Coach”) in any media, now known or hereafter developed or invented, is prohibited without the express written permission of Strategic Coach^®. You agree not to record, upload, teach, coach, share, or otherwise distribute the content and materials shared during the Event, in whole or in part. You may use the materials that are provided in connection with the Event internally in connection with your business. This permission is revocable in the event of misuse and does not permit you, your company, your employees, and/or anyone associated with you or your company to use these materials or any other intellectual property of Strategic Coach^® in any other way or for any other purpose.

Confidentiality

You agree to keep confidential any materials relating to or that may be shared during the Event by Strategic Coach^®, by its coaches or employees, or by your fellow participants. This includes, but is not limited to, any story or other show of concepts and any materials or information supplied by third parties that you may be given access to or that may be shared or discussed during the Event. You agree not to release such information or materials during or after the completion of the Event without the prior written approval of the relevant owner and Strategic Coach^®. Any information and/or materials you may disclose to the participants and Strategic Coach^® during the Event will be considered as being released with your consent. Strategic Coach^® will not be held liable for the actions of any third parties. Any workbooks, viewing materials, or links, etc. that may be supplied or information that may be shared will be for the educational and informational purposes of the Participant only in relation to the Event. Recording of the Event, whether in whole or in part, is not permitted.

Some Additional Rights Reserved By Strategic Coach^®

Strategic Coach^® has the right to reschedule the Event, change the venue, substitute coaches or speakers, and/or change in-person Events into engaging virtual-only-basis Events using videoconferencing services. Strategic Coach^® reserves the right to decline or terminate your participation in the Event for any reason at any time, including, for example, for failing to comply with these Terms and Conditions. Strategic Coach^® cannot be held liable for any expenses incurred as a result that the Event reaches capacity and your enrollment was not confirmed, there is a change in venue, or if the delivery method of the Event changes.

Responsibility For Your Decisions

The Event is not a substitute for the advice of any of your personal or professional advisors; therefore, you agree that all of your decisions and actions, and their consequences, are entirely your own responsibility. You understand and agree that you are not entitled to rely on such services or products. Strategic Coach^® does not accept any responsibility or liability for the accuracy, content, completeness, legality, or reliability of the information shared during the Event. Strategic Coach^® shall not be liable for any loss or damage whatsoever that may arise as a result of your use of the information in the Event. Any reference to any service or product does not constitute an endorsement or recommendation by Strategic Coach^®. While we may reference certain results, strategies, best practices, outcomes, and/or situations in the Event, you understand and acknowledge that we make no guarantees as to the accuracy of third-party statements and/or advice. You agree to keep confidential any materials and tools relating to or that may be shared by Strategic Coach^®, by its coaches, by its speakers, or by its employees. This includes, but is not limited to, any story or other show of concepts and any materials or information supplied by third parties that you may be given access to or that may be shared or discussed during the Event. Any communications made in collaboration among the participants is not held privileged or confidential and is subject to viewing and distribution by third parties. However, you agree not to release personal information during or after the completion of the Event without the prior written approval of the relevant owner.

Release Of Liability

You release Strategic Coach^® and its officers, directors, owners, and employees from any and all liability arising from or connected to the Event. You also agree to release Strategic Coach^® from any responsibility if you choose to accept Strategic Coach’s offer to provide and/or arrange transportation to and from the Event.

Assumption Of Risk And Waiver Of Liability

By attending and voluntarily participating in any sponsored Events by Strategic Coach^®, you agree and understand that there are inherent risks of exposure to any communicable or infectious disease, which exist in any public place where people are present, and that no precautions can eliminate the risk of exposure to any communicable disease. You agree to voluntarily assume any and all risks in any way related to exposure to any communicable or infectious disease, related to attending and/or participating in the Event. In addition to taking responsibility for your own health and safety, you agree to follow the protocols dictated by public health and those of the venue where the Event is being held. You agree to assume all the foregoing risks and accept sole responsibility for your health and safety, and you discharge Strategic Coach^® of any liability that may otherwise arise due to any exposure to any infectious disease at or near or in transit to/from the venue, and/or in relation, directly or indirectly, to the Event. You agree to release Strategic Coach^® from any and all causes of action, claims, demands, requests, damages, or any recourse whatsoever in respect of any personal injuries or other damages that may occur or arise as a result of exposure to any infectious communicable disease. You understand and agree that you are not relying on Strategic Coach^® to have arranged for, or carry, any insurance of any kind for your benefit relative to your attendance and participation in the Event and that you are solely responsible for obtaining any mandatory or desired life, travel, accident, property, or other insurance related to your attendance and participation in a Strategic Coach^® Event at your own expense.

Privacy Policy: Protecting Your Personal Information

This Privacy Notice below summarizes some of the ways in which Strategic Coach^® collects, uses, protects, and discloses information about you. A full version of Strategic Coach’s Privacy Policy practices in relation to The Strategic Coach^® Program is available at www.strategiccoach.com/privacy. No amendment to these Terms will be effective unless in writing and signed by Strategic Coach^® and you. Neither party may assign all or any part of this Contract without the other parties’ written consent. We will not reveal any of your confidential information that we learn of as a result of preparing for or conducting the Event.

Strategic Coach^® collects personal information in the Confidential Application as part of the application process (“Personal Information”). By providing Personal Information to Strategic Coach^®, you consent to Strategic Coach^® using the information for the purposes specified in our Privacy Policy. Current participants of The Strategic Coach^® Program agree to having their professional and/or personal contact information stored and posted on Coach Connect and understand that said information can and may be accessible by other participants in the workshops. If you do not wish to share your information with other participants, you can opt out by emailing us at legalinfo@strategiccoach.com. Strategic Coach^® does not rent, sell, or otherwise disclose Personal Information about its participants to third parties. Strategic Coach^® may allow authorized third-party service providers access to Personal Information to perform services on its behalf. Payments processed via our Platform may be provided by a third-party payment processor and are subject to the terms of use and privacy policies of those payment gateways and are not accessible to or controlled by Strategic Coach^®. You hereby authorize the third-party agent to charge your credit card for the Services, both in advance and on a periodic, renewal basis if applicable and in accordance with any terms and conditions of your Application. These service providers are required to provide appropriate privacy protection for the Personal Information, comparable to that of Strategic Coach^®, and to limit their use of such information to providing services on behalf of Strategic Coach^®. Strategic Coach^® will use its best efforts to protect your Personal Information against loss and unauthorized use. Our sessions may also be monitored and recorded for quality assurance and training purposes. If any part of these Terms is declared invalid or unenforceable by a court of competent jurisdiction, the balance of these Terms shall remain valid. The laws of Ontario and Canada govern this Agreement. The parties accept the jurisdiction of the Courts of Ontario in Toronto, Ontario, to adjudicate any dispute relating to the contract.

Miscellaneous. Neither Strategic Coach^® nor any of our respective employees, agents, representatives, service providers, or sponsors takes any responsibility for your personal effects or possessions. Please keep your personal effects and possessions in a safe place at all times. If you have any questions, please speak with a venue representative.
